Ultra Connected Wellness Client Terms and Conditions
The Massage Therapy Client Terms and Conditions (the “Agreement”), is between Tammy G., LMT, LLC, d/b/a Ultra Connected Wellness, a New Jersey Limited Liability Company (collectively “Therapist”) with an address of 261 Springfield Ave, Suite 102, Berkeley Heights, New Jersey 07922, and the individual to be treated that has affirmed reviewing Therapist’s Terms and Conditions below (“Client”).
1. Services
1.1 Scope. Therapist provides non-medical, professional massage and bodywork services, including Massage Bodywork and/or Energy Healing, solely for relaxation, stress reduction, and the relief of muscle tension. No diagnosis, medical treatment, chiropractic, or physical therapy services are provided.
1.2 Session Details. Sessions are offered in durations of 60, 90, or 120 minutes. The session includes intake, assessment, and time for dressing/undressing within the stated duration. Certain bodywork techniques may take less time to complete than the session duration which will be supplemented by Therapist with additional complimentary techniques for the remaining time available.
1.3 Professional Standards. Therapist is licensed in New Jersey as a Massage and Bodywork Therapist, License No.: 18KT00743900, and will practice within the scope of New Jersey law and applicable local regulations.
2. Client Health Information and Consent
2.1 Health Disclosure. Client agrees to complete an intake form and disclose all known health conditions, injuries, surgeries, allergies, pregnancy status, medications (including blood thinners), and contraindications. Client agrees to update Therapist before each session about any changes to health status.
2.2 Fitness to Receive Massage. Client represents that Client is able to receive massage services. If Client is under the care of a physician or other healthcare provider, Client agrees to seek guidance about the appropriateness of massage and provide any required written clearance.
2.3 Informed Consent. Client understands the nature, benefits, and potential risks of massage (including temporary soreness, redness, lightheadedness, or bruising) and consents to receive massage. Client may request modifications or stop any technique at any time.
2.4 Comments & Concerns: Comments and/or concerns about Therapist’s services or professional conduct may be directed to the practice via the Client Survey Satisfaction Form provided by Therapist.
2.5 Minors. For Clients under the age of 18, a parent/legal guardian must sign and consent to the [Parental Consent Form for Minor Services attached as Addendum A. ]
3. Boundaries and Conduct
3.1 Professional Boundaries. Massage is strictly therapeutic. Any inappropriate language, solicitation, or behavior will result in immediate termination of the session and potential reporting to authorities as required by law or within Therapist discretion. Clients who violate this section will be charged for their entire appointment.
3.2 Draping. Professional draping will be used at all times. Only the area being worked on will be undraped.
3.3 Right to Refuse Service. Therapist may refuse or terminate a session for any reason consistent with law, including illness, intoxication, hygiene concerns, or safety considerations. Client agrees to shower before their session and arrive in a hygienic condition.
3.4 Undressing Procedure. Therapist will not assist or undress clothing from Client. Areas that remain clothed with be considered a Client boundary and will not be touched.
4. Consent to Touch and Areas Worked
4.1 Consent. Client consents to appropriate therapeutic touch to the following areas as needed and agreed: back, neck, shoulders, arms, hands, legs, feet, hips, abdomen, scalp, face, and gluteal region (over drape unless otherwise expressly consented). Breast tissue will not be massaged. Genital contact is strictly prohibited.
4.2 Ongoing Communication. Therapist will explain techniques and pressure. Client agrees to communicate preferences, discomfort, or pain immediately so adjustments can be made.
5. Aftercare Instructions and Client Responsibility
5.1 Aftercare Guidance. Therapist may provide post-session aftercare recommendations, including hydration, stretching, rest, or activity modifications tailored to Client’s needs.
5.2 Client Responsibility. Client is solely responsible for following or declining aftercare recommendations and for seeking timely medical advice as needed. Therapist shall not be liable for outcomes resulting from Client’s failure to follow aftercare guidance or to obtain appropriate medical care, except to the extent caused by Therapist’s gross negligence, willful misconduct, or violation of law.
6. Health and Safety Disclosures
6.1 Contraindications. Massage may be contraindicated for certain conditions (including acute infections, fever, uncontrolled hypertension, certain skin conditions, recent injuries/surgeries, neurological, cardiovascular, and pulmonary conditions, and high-risk pregnancy). Client agrees to inform Therapist of any such conditions and agrees to provide appropriate medical documentation affirming ability to be treated.
6.2 Communicable Diseases. Client confirms they do not currently have symptoms consistent with a contagious illness. Therapist reserves the right to refuse service if Client does not appear to be non-symptomatic as confirmed.
6.3 Fragrance and Allergens. Products used may contain oils or fragrances. Client should inform Therapist of sensitivities. Hypoallergenic options may be available upon request.
6.4 Medical Emergencies. In the event of a medical emergency, Therapist may discontinue the session and contact emergency services. Client consents to such action and is responsible for any related costs.
7. Fees, Payment, and Gratuities
7.1 Fees. Current rates are confirmed with the service Client chooses from Therapist’s website portal inclusive of all applicable fees and taxes. Rates may change with notice posted at the practice or on the practice website.
7.2 Payment. 50% of the invoice amount is due within 48 hours of booking. Accepted forms of payment include: cash, debit card, electronic bank transfer, and credit cards subject to any third-party service fees to be paid by Client. If insurance reimbursement is sought, Client is responsible for payment to Therapist and for any submissions to insurance unless otherwise agreed in writing. Client must share insurance information with Therapist for individuals seeking insurance reimbursement.
7.3 Late Arrival. Sessions start and end at the scheduled times. If Client arrives late, the session may be shortened, and the full fee will apply. Clients arriving over 15 minutes late may have their services canceled subject to the Therapist’s discretion and will be charged for their entire appointment.
7.4 Gratuities. Gratuities are optional and not required.
8. Scheduling, Cancellations, and No-Shows
8.1 Cancellation Notice. Client must provide at least 24 hours’ notice to cancel. Refunds are not guaranteed.
8.2 Late Cancellation Fee. Cancelling services with less than 24 hours’ notice shall be charged 50% of the scheduled service fee. Clients rescheduling with less than 24 hours’ notice will be subject to a $25 rescheduling fee only upon confirmation by Therapist.
8.3 No-Show Fee. No-shows shall be charged 100% of the scheduled service fee.
8.4 Illness. To protect health and safety, Client agrees to cancel if experiencing contagious illness or fever. Fees for illness-related cancellations made prior to the appointment may be waived at Therapist’s discretionand upon providing appropriate medical documentation proving illness occurred.
9. Gift Certificates, Packages, and Promotions
9.1 Gift Certificates. Gift certificates are valid for thirty (30) days or ninety (90) days dependent on the terms agreed upon between Therapist and Client when the gift certificate is purchased and are nonrefundable, except as required by law. Lost or stolen certificates will not be replaced without proof of purchase.
9.2 Packages. Prepaid packages are non-transferable, nonrefundable and expire subject to the terms agreed upon between Therapist and Client when package is purchased. Missed sessions are subject to the cancellation policy.
9.3 Promotions. Promotional pricing applies only during the stated promotional period and cannot be combined with other offers unless stated. Therapist will not honor any competitor pricing, promotions, or other offers presented by Client and will adhere to Therapist’s own pricing and promotional dealings.
10. Privacy and Confidentiality
10.1 Records. Therapist will maintain client records, including intake and session notes, in a confidential manner.
10.2 Use and Disclosure. Client information will be used to provide services, manage scheduling and billing, and as required by law. Records will not be disclosed without Client’s written authorization except as required or permitted by law, including but not limited to: threats of serious harm to self or others; response to a valid court order or subpoena; or as required by public health or licensing authorities.
10.3 Access. Upon written request, Client may access or request a copy of records, subject to reasonable copying fees and applicable law.
11. Recording and Surveillance Policy
11.1 No Client Recording. To protect privacy, safety, and professional boundaries, Client and any accompanying person shall not audio- or video-record any portion of the session or within treatment areas without Therapist’s prior consent.
11.2 Practice Security Measures. The practice may employ non-recording door cameras or limited-use security cameras in non-treatment common areas for safety and security; no audio or video recording will occur in treatment rooms or restrooms.
11.3 Compliance and Remedies. Any unauthorized recording may result in immediate termination of the session, deletion or surrender of recordings to the extent permitted by law, and pursuit of available remedies.
11.4 Modeling Addendum. For Clients engaged in Modeling Activates on behalf of Therapist for promotional, marketing, and/or business purposes, Client agrees to be audio and/or visually recorded with Client's permission.
12. Communication, Photos, and Testimonials
12.1 Communications. Client consents to being contacted for scheduling, reminders, and practice updates by phone, text, or email. Client may opt out of non-transactional communications at any time.
12.2 Photos/Testimonials. Therapist will not use Client’s name, image, or testimonial for marketing without Client’s separate authorization.
13. Client Responsibility for Personal and Therapist Property
13.1 No Bailment; Limited Liability. Client is solely responsible for Client’s personal property brought to the premises. Therapist is not a bailee and shall not be liable for loss, theft, or damage to Client’s belongings, except to the extent directly caused by Therapist’s gross negligence or willful misconduct.
13.2 Valuables. Client is advised not to bring valuables to appointments and to keep personal items secured.
13.3 Client Damages to Therapist’s Property. Client is responsible for all damages caused to Therapist's property caused by Client’s actions, inclusive of damages caused to Therapist’s equipment, sheets, draping, and other required items needed for Therapist to perform agreed upon services.
14. Acknowledgments and Required Disclosures
14.1 No Medical Claims. Massage is not a substitute for medical care, diagnosis, or treatment. Therapist does not diagnose, prescribe, or treat medical conditions and will refer clients to seek appropriate healthcare providers.
14.2 Pregnancy. Prenatal massage is available to pregnant Clients with appropriate modifications. Client agrees to disclose pregnancy and any related complications. Written provider clearance is required for Client’s experiencing medically diagnosed high risk pregnancy issues. Client’s failure to notify Therapist of such pregnancy complications will result in the immediate termination of Therapist’s services, and Therapist will be held harmless of any complications attributable to such services.
14.3 Client Rights. Client has the right to be treated with dignity, to ask questions, to stop or refuse any technique, and to end the session at any time.
15. Waivers and Assumption of Risk
15.1 Assumption of Risk. Client understands and accepts the inherent risks associated with massage therapy and voluntarily assumes those risks.
15.2 Release. To the fullest extent permitted by New Jersey law, Client releases and holds harmless Therapist and the practice from claims, damages, or liabilities arising from services provided, except to the extent caused by Therapist’s gross negligence, willful misconduct, or violation of law.
15.3 Limitation. Nothing in this Agreement waives rights that cannot be waived under New Jersey law.
16. Entire Agreement Acknowledgement
16.1 Entire Agreement. This is the Entire Agreement between the parties and supersedes prior discussions.
16.2 Amendments. Policies and rates may be updated with notice posted at the practice or on the practice website. Material changes to this Agreement will be presented for Client acknowledgment.
16.3 Severability. If any provision is found invalid, the remainder will continue in effect.
16.4 Governing Law and Venue. This Agreement is governed by the laws of the State of New Jersey. Any dispute will be brought in the state courts located in Union County, New Jersey, subject to applicable law.
16.5 Non-Discrimination. Therapist does not discriminate on the basis of any protected characteristic under applicable law. Therapist is certified as a Small Business Enterprise, Minority & Women Owned Business Enterprise, and as a LGBTQ+ Owned Enterprise in accordance with New Jersey registration requirements.
16.6 No Guarantee. No specific outcome is guaranteed.
17. Dispute Resolution; Mediation and Arbitration
17.1 Good-Faith Negotiation and Mediation. The parties agree to first attempt in good faith to resolve any controversy, claim, or dispute arising out of or relating to this Agreement or the services provided (a “Dispute”) through informal discussions. If not resolved within thirty (30) days, the parties shall submit the Dispute to non-binding mediation before a mutually agreed mediator in Union County, New Jersey, with fees shared equally.
17.2 Binding Arbitration. If the Dispute is not resolved in mediation within sixty (60) days of a written request for mediation, the Dispute shall be resolved by confidential, binding arbitration before a single arbitrator in Union County, New Jersey.
17.3 Prevailing Party. In any action, arbitration, or proceeding arising out of or relating to this Agreement, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and costs, including fees and costs incurred in enforcing any judgment or award.
18. Force Majeure
18.1 Excused Performance. Therapist shall not be liable for any delay or failure to perform any obligation (including scheduling or providing services) to the extent caused by events beyond Therapist’s reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, labor disputes, governmental actions, interruptions in transportation or utilities, or other similar events.
18.2 Suspension and Rescheduling. Obligations affected by a force majeure event shall be suspended for the duration of the event, and appointments may be canceled or rescheduled without liability; any prepaid amounts for unrendered services will be credited or refunded at Therapist’s discretion, consistent with posted policies.
18.3 Client Obligations Pursuant to Force Majeure Event. Therapist requests that Clients reschedule services free of charge within thirty (30) days of Force Majeure Event and may submit supporting documentation.
19. Acknowledgment and Consent
19.1 Survival. Sections 6 through 19 shall survive termination or completion of services.
19.2 Client Acknowledgment of Terms and Conditions. By confirming via the check box included within Therapist’s Client Service Portal, Client acknowledges that they have read and understand this Agreement, had the opportunity to ask questions, and consent to receive massage services under the terms above. Client affirms that all information provided is accurate and agrees to update Therapist of any changes to health status before future sessions.
